Amendment #6; Proposed, submitted by Petition

ARTICLE __: Amend the Kearsarge Lighting Precinct Zoning Ordinance, Article V, Residential-
Agricultural District, by adding the following:

Section A. Uses Permitted:

12. Accessory Dwelling Unit (ADU)

Section B. Criteria for Permitted Uses:

1. Residential Properties
i. Accessory Dwelling Units (ADUs). In accordance with NH RSA 674:72 and NH RSA 674:73, one (1) ADU is permitted, either attached or detached, in accordance with the following criteria:

  1. A single ADU per lot of record may be permitted.
  2. The Residence must be owner occupied.
  3. All ADUs must conform to building regulations including setbacks, have adequate provision for water supply and septic in accordance with NH RSA 674:72.V. If the existing septic does not meet current requirements, a new or modified septic system will be required.
  4. The ADU shall be limited to a maximum of two (2) bedrooms.
  5. Number of occupants limited to a maximum of two (2) per bedroom.
  6. No additional driveway shall be permitted for an ADU but a minimum of one (1) off-street parking space shall be provided per bedroom.
  7. The owner of the single family, owner-occupied, dwelling may reside in either dwelling as described herein.
  8. The ADU shall be no greater than eight hundred (800) square feet.
  9. The appearance, style, color and design of the ADU should be consistent with the primary dwelling or structure.

Article X. Definitions


Add the following definitions to Article X:

Accessory Dwelling Unit (ADU): is a residential living unit, (a) that is either attached or detached to a single family, owner-occupied, dwelling, (b) that provides independent living facilities for one or more persons, including provisions for sleeping, eating, cooking, and sanitation in accordance with NH RSA 485-A:38 (“Approval to Increase Load on a Sewage Disposal System”), on the same parcel of land as the principal single family, owner-occupied, dwelling it accompanies, and (c) otherwise meets the ADU requirements contained in this ordinance.

Owner Occupied: The owner (if multiple owners, an owner) must be in residence at the time the rental is occurring.
