Amendment #4; Commissioner Proposed

ARTICLE __: Amend the Kearsarge Lighting Precinct Zoning Ordinance, Article V, Residential-Agricultural District, by adding the following: 

 

Section A. Uses Permitted:

 

12. Attached Accessory Dwelling Unit (ADU)

 

Section B. Criteria for Permitted Uses:

 

Residential Properties

 

i. Accessory Dwelling Units (ADU). In accordance with NH RSA 674:72, one (1) ADU is permitted in accordance with the following criteria: 

 

In accordance with NH RSA 674:72 (“Accessory Dwelling Units”), one (1) ADU is permitted and will be created within the existing single family, owner-occupied, dwelling; or through the construction of an addition to the existing single family, owner-occupied, dwelling; or by the construction of a new single family, owner-occupied, dwelling (on a vacant lot) which will include both a primary single family, owner-occupied, dwelling and an ADU.  

The ADU shall be located within or as an addition to the primary single family, owner-occupied, dwelling and is not permitted in detached or accessory structures.  An ADU must be attached to the single family, owner-occupied, dwelling by means of a common interior wall, floor and ceiling of each dwelling, or be connected by a fully enclosed structure with occupiable space. An interior door shall be provided between the principal dwelling unit and the ADU and the ADU may not exceed two (2) bedrooms.  

The owner of the single family, owner-occupied, dwelling may reside in either dwelling as described herein. 

The ADU shall be no greater than eight hundred (800) square feet. 

The occupancy of the ADU shall be limited to two (2) people per bedroom.

 

Article X. Definitions 

 

Add the following definition to Article X:

 

Accessory Dwelling Unit (ADU): A residential living unit, (a) that is within or attached to a single family, owner-occupied, dwelling, (b) that provides independent living facilities for one or more persons, including provisions for sleeping, eating, cooking, and sanitation in accordance with NH RSA 485-A:38 (“Approval to Increase Load on a Sewage Disposal System”), on the same parcel of land as the principal single family, owner-occupied, dwelling it accompanies, and (c) otherwise meets the ADU requirements contained in this ordinance.
